Agreement to these terms

These Terms of Service ("Terms") govern access to and use of the GearJoT website and platform ("Service") provided by GearJoT ("we," "our," or "us"). By creating an account, starting a trial, or using the Service, you agree to these Terms on behalf of yourself and, where applicable, the organization you represent. If your organization has a separate signed agreement with GearJoT, that agreement controls where it conflicts with these Terms.
The service
GearJoT is a configurable workspace for equipment-driven businesses. It supports equipment and asset records, inspections, issues and resolution, tasks and workflows, team collaboration, knowledge capture, and integrations with third-party systems such as telematics providers. Features vary by plan, and we improve the Service on an ongoing basis.
Accounts and acceptable use
You must provide accurate registration information, keep your credentials secure, and notify us promptly of any unauthorized use of your account. You are responsible for activity that occurs under your account and for ensuring your team's use of the Service complies with these Terms and applicable law.
You agree not to misuse the Service, including by: using it for unlawful purposes; interfering with or disrupting its operation; attempting to access systems or data you are not authorized to access; reselling it without our agreement; submitting false or misleading information; or uploading malicious code.
Trials, subscriptions, and billing
Paid plans are billed as described at the time of purchase on our pricing page or in your order. Trials convert to paid plans only when you choose a plan. Fees are exclusive of taxes unless stated otherwise, and except where required by law, payments are non-refundable. We may change pricing with notice; changes apply at your next renewal.
Your data
Your organization owns the equipment, inspection, and operations data it stores in the Service. You grant us the rights needed to host, process, transmit, back up, and display that data in order to operate, secure, support, and improve the Service. Our collection and handling of personal information is described in the GearJoT Privacy Policy.
You are responsible for the accuracy and legality of the data you upload and for having the rights necessary to use it with the Service. On termination, we will make your data available for export for a reasonable period before deletion, consistent with your plan or agreement.
Intellectual property
The Service, including its software, design, and content we provide, is owned by GearJoT or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. Feedback you provide may be used to improve the Service without obligation to you.
Third-party services and integrations
The Service can connect to third-party products such as telematics platforms and other integrations you enable. Those products are governed by their own terms, and we are not responsible for them. Enabling an integration authorizes us to exchange relevant data with it on your behalf.
Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. GearJoT supports your equipment operations but does not replace professional judgment: inspection outcomes, maintenance decisions, safety compliance, and equipment operation remain your responsibility, and AI-assisted features provide informational suggestions only.
Limitation of liability
To the maximum extent permitted by law, GearJoT will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities, even if advised of the possibility. Our total liability for claims arising out of or relating to the Service is limited to the amounts you paid us for the Service in the twelve months before the event giving rise to the claim.
Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access for material breach of these Terms, for non-payment, or where required to protect the Service or comply with law, and we will use reasonable efforts to notify you. Sections that by their nature should survive termination, including data ownership, disclaimers, and limitation of liability, survive.
Governing law, changes, and contact
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in Kentucky, unless a signed agreement between us says otherwise.
We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify customers through the product or by email. Continued use of the Service after changes take effect means you accept the updated Terms.
